People falsely accused of a child sex crime often have never had any contact with the legal system, other than a speeding ticket or two. Tom believes it is important to educate his clients on exactly what they are facing.

In general, child sex crimes can be divided into two categories: (i) sexual acts, such as oral sex, rape and sodomy; and (ii) sexual contact, which occurs when a child touches you or you touch a child without any penetration. Sexual acts are punished most harshly.

Child Sexual Abuse in Maryland

The definition of, and punishment for, sexual abuse of a child differ from state to state. In Maryland, sexual abuse of a minor includes:

  • Molestation or exploitation of a minor, whether or not physical injuries are sustained
  • Incest
  • Oral Sex
  • Rape
  • Sodomy
  • Sexual offenses in the 1st degree, 2nd degree, 3rd degree and 4th degree
  • Unnatural or perverted sexual acts

Parents, household members or anyone else who has temporary or permanent or responsibility for the care and supervision of a minor can be found guilty of sexual abuse of a child. Those convicted of child sexual abuse can be sentenced to up to 25 years in prison.

The charge of sexual abuse of a minor can be separate from, and in addition to, charges for the specific sexual acts which lead to the charge of abuse.
